These Terms of Service (“Terms”) govern your access to and use of the website located at
branchouttreecare.com and any subdomains (the “Site”), and your purchase or use of tree care,
arborist, and plant health care services (the “Services”) provided by Branch Out Tree Care, Inc.
(“Branch Out Tree Care,” “we,” “us,” or “our”). By using the Site, requesting an estimate, or
engaging us for work, you agree to these Terms. If you do not agree, please do not use the Site
or our Services.


1. Who we are
Branch Out Tree Care, Inc. is a family-owned and operated tree care company serving the
greater Santa Barbara, California area, including Montecito, Goleta, Carpinteria, Summerland,

2. Use of the Site
You may use the Site for lawful purposes only. You agree not to use the Site in any way that
could damage, disable, overburden, or impair it, or interfere with anyone else’s use of it. You
agree not to attempt to gain unauthorized access to any part of the Site, other accounts, or any
systems or networks connected to the Site, and not to use any automated means to scrape,
harvest, or collect information from the Site without our prior written permission.


3. Intellectual property
All content on the Site — including text, graphics, logos, the “Branch Out Tree Care” name and
marks, images, photographs, and the overall look and feel — is owned by or licensed to Branch
Out Tree Care, Inc. and is protected by copyright, trademark, and other laws. You may view and
print pages for your own personal, non-commercial use, but you may not copy, reproduce,
republish, distribute, or create derivative works from any Site content without our prior written
consent.


4. Requesting estimates and contacting us
When you submit our online lead form, request an estimate, or otherwise contact us, you agree
to provide accurate and complete information. Submitting a request does not create a binding
agreement for Services; it is an invitation for us to provide an estimate or to discuss your needs.
Information you submit is handled in accordance with our privacy practices.


5. Estimates, proposals, and scope of work
We typically provide a free on-site evaluation for residential homeowners; fees may apply for
evaluations related to real estate transactions, consulting, or specialized arborist reports.

Estimates are based on the conditions observed at the time of inspection and the scope of work
described in our proposal. The scope of work, pricing, and any exclusions will be set out in the
written estimate or proposal we provide. If conditions change, hidden hazards or defects are
discovered, or you request additional work, pricing and timelines may be adjusted, and we will
communicate any material changes to you. Estimates are valid for the period stated in the
proposal or, if none is stated, for 30 days.


6. Scheduling, property access, and your responsibilities
To perform the Services, you agree to provide safe and reasonable access to the work area on
the scheduled date(s). You are responsible for: identifying property lines and any disputed trees
or boundaries; informing us of underground utilities, irrigation lines, septic systems, pet
enclosures, or other hidden features; securing pets; and moving vehicles, patio furniture, and
other personal property away from the work area. Weather, site conditions, equipment
availability, and safety considerations may require us to reschedule; we will make reasonable
efforts to notify you in advance.


7. Utility lines and permits
For work near power lines or other utilities, we follow applicable safety practices and may
coordinate with the utility provider. Where a permit, homeowners’ association approval, or other
authorization is required for tree work (for example, certain protected or heritage trees), it is your
responsibility to confirm and obtain any required approvals unless we have agreed in writing to
handle them on your behalf. You represent that you are the property owner or are authorized by
the owner to request the Services.


8. Payment terms
Unless otherwise stated in your proposal, payment is due upon completion of the work. We may
require a deposit for larger projects. Accepted payment methods will be identified on your
estimate or invoice. Past-due balances may be subject to a late charge and to the costs of
collection (including reasonable attorneys’ fees) to the extent permitted by law. We reserve the
right to suspend or stop work if payment is not made when due.


9. Cancellations and rescheduling
If you need to cancel or reschedule, please notify us as early as possible. We ask for
reasonable advance notice so we can adjust our crew schedule. Any deposit or cancellation
terms specific to your project will be described in your proposal.


10. Workmanship and warranty
We are a fully licensed and insured tree care company, and our work is performed by
experienced personnel, including ISA Certified Arborists, following professional arboricultural
practices. We stand behind the quality of our workmanship and will address legitimate concerns
promptly and professionally. Because trees are living organisms affected by weather, pests,
disease, soil, and other factors beyond our control, we do not and cannot guarantee the future
health, survival, growth, or condition of any tree or plant, or that any tree will not fail. Plant
health care treatments are provided on a best-efforts basis and results may vary. Any specific
warranty for a project will be stated in writing in your proposal; that written warranty is the only
warranty we provide.

Services and our SMS Terms & Conditions, constitute the entire agreement between you and
Branch Out Tree Care, Inc. regarding the Site and the Services.

The Site and its content are provided “as is” and “as available” without warranties of any kind,
whether express or implied, including warranties of merchantability, fitness for a particular
purpose, and non-infringement. Information on the Site (including blog posts and general tree
care guidance) is for general informational purposes only and is not a substitute for a
professional, site-specific evaluation. We do not warrant that the Site will be uninterrupted,
secure, or error-free.


12. Limitation of liability
To the fullest extent permitted by law, Branch Out Tree Care, Inc. and its owners, employees,
and contractors will not be liable for any indirect, incidental, special, consequential, or punitive
damages, or for lost profits or lost data, arising out of or related to your use of the Site or the
Services. To the fullest extent permitted by law, our total liability for any claim arising out of or
related to the Services will not exceed the amount you paid to us for the specific work giving rise
to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
This section does not affect rights or remedies provided by our insurance coverage or by law.


13. Indemnification
You agree to indemnify and hold harmless Branch Out Tree Care, Inc. from claims, damages,
and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms,
your misrepresentation of property ownership or boundaries, or your failure to disclose hazards
or obtain required permits or approvals.


14. Third-party links and services
The Site may contain links to third-party websites and embedded services (for example,
mapping, online forms, and review platforms). We do not control and are not responsible for the
content, policies, or practices of those third parties. Your use of third-party services is governed
by their own terms and privacy policies.


15. Text messages
If you opt in to receive text messages from us, your participation is also governed by our SMS
Terms & Conditions, available on the Site. Message and data rates may apply, and you can opt
out at any time as described in those terms.


16. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated”
date above. Your continued use of the Site or Services after changes take effect constitutes
your acceptance of the revised Terms.


17. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-
laws rules. Any dispute arising out of or relating to these Terms, the Site, or the Services will be
brought exclusively in the state or federal courts located in Santa Barbara County, California,
and you consent to the personal jurisdiction of those courts. Before filing any claim, you agree to
first contact us so we can attempt to resolve the matter informally.


18. Severability and entire agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will
remain in full force and effect. These Terms, together with any written estimate or proposal for
